2. In view of the endorsement made by the learned counsel appearing for the petitioner, this criminal original petition is dismissed as withdrawn. However, the petitioner is at liberty to file a petition under Section 311 Cr.P.C., before the concerned Court, and when filed, the trial Court is required to dispose of it on its merits. Consequently, connected Miscellaneous Petition is closed.
