This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondent to dispose of the appeal proceedings Page No. 1 of 4

in A1/1782/24, preferred by the petitioner on 03.10.2024, in accordance with law, within the time stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The grievance of the petitioner is that the petitioner is the owner of the property. However, the revenue authorities, without issuing any notice to the petitioner and in violation of the principles of natural justice, have illegally mutated the patta in favour of the fraudulent purchaser's nominee. Therefore, the petitioner filed an appeal before the respondent on 03.10.2024 in A1/1782/24 seeking cancellation of the said mutation. Till date, the said appeal has not been disposed of. Hence, the petitioner has been constrained to file the present Writ Petition.

4. The learned Government Advocate appearing for the respondent, on instructions, would submit that the petitioner's appeal dated 03.10.2024 would be considered and appropriate orders would be passed within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the respondent to consider the petitioner's appeal dated 03.10.2024 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The appeal shall be disposed of after conducting an enquiry. The respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
