PRAYER:- For Bail in Crime No.8 of 2022 on the file of the respondent herein. ORDER:- The Court made the following order:- The petitioner is the Sole Accused, who was arrested and remanded to judicial custody on 20.07.2023, for the offences punishable under Section 5(1), 5(j)(ii) r/w 6(1) of Protection of Children from Sexual offences Act, 2019 in Crime No.8 of 2022, on the 1/3
file of the respondent police, seeks bail.
2.The case of the prosecution is that the the defacto complainant is the victim girl, studying 10th standard. The accused has committed penetrative sexual assault on her on 23.01.2023 and threatened her by saying that if she says about this incident to anybody, he will not marry her. She was found pregnant and thereafter gave the present complaint. She delivered a female child on 23.07.2023, but the child died on 25.07.2023. In the meantime, the accused refused to marry her and went to Kerala. Hence the complaint.
3. Learned Additional Public Prosecutor submitted that final report is filed in Spl.S.C.No.36 of 2023 before the Mahila Court, Pudukkottai. Now, proceedings under Section 227 of Cr.P.C and the application for discharge are pending.
4. In view of the above said submission, I find no reason to entertain this petition at this stage. The petitioner can approach the concerned Court for bail.
