Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 294(b), 323, 324, 448, 506(ii) IPC and Section 4 of Tamil Nadu Prohibition Women Harassment Act in Cr.No.3 of 2019 on the file of the respondent police, seek anticipatory bail.
2.It is the case of the prosecution that the petitioner and the victim are neighbours. In an earlier occasion, the petitioner misbehaved with the defacto complainant and sexually harassed the defacto complainant. On 12.01.2019 at 5.30 a.m., when the defacto complainant's husband left the house for purchasing milk, at that time, the petitioner entered into the defacto complainant's house and and pulled her hand and assaulted her minor daughters. At that time, there was a quarrel between them in which, the petitioner attacked the defacto complainant and her husband and bit her daughter in thigh and also attacked the another daughter and escape from the scene of occurrence, thereby, the defacto complainant gave a complaint before the respondent police.

prosecution. He further submitted that there was a civil dispute between the petitioner and the defacto complainant. 4.The learned Government Advocate (Criminal side) appearing for the State submitted that the petitioner bit the defacto complainant's minor daughter in thigh and also attacked the another daughter, due to which, they were sustained injury. Hence, he opposed to grant bail.
5.Considering the facts and circumstances of the case and considering the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail. Hence, this criminal original petition is dismissed.
