Crime No. 96 of 2013 : Respondent PRAYER: Petition is filed under Section 482 of the Criminal Procedure Code praying to direct the respondent to file the charge sheet in Crime No.96 of 2013 on the file of the respondent police within the time frame as may be fixed by this Court.

ORDER

The petitioner has come forward with this petition under Section 482 of Code of Criminal Procedure,seeking a direction to the respondent to file the charge sheet in Crime No.96 of 2013 on the file of the respondent police within the time frame as may be fixed by this Court

2. Heard the submissions made by the learned counsel appearing on either side.

3. The learned counsel for the petitioner would submit that on the basis of the complaint given by the petitioner, a case has been registered in Crime No.96 of 2013 for the offences punishable under Sections 6(2)(3) of TNSC (RDCS) Order 1982 and 17 of TNK (RT) Order 1973 r/w 7(1)(a)(ii) of EC Act 1955. The learned counsel further submitted that the respondent has not shown any interest to investigate the matter and lay a final report. Hence, the petitioner has come up with the present petition for the relief as stated above.

4. Resisting the same, the learned Government Advocate (Crl.side) would submit that investigation is going on and hence, he prays for one month time to complete the investigation and file a final report.

5. Considering the submissions made on both sides, this Court is inclined to grant one month time to the respondent to complete the investigation and file a final report. https://hcservices.ecourts.gov.in/hcservices/

6. Accordingly, the respondent is directed to complete the investigation in Crime No.96 of 2013 and file a final report, within a period of one month from the date of receipt of copy of this order.

7. The Criminal Original Petition is disposed of with the above direction.
