JUDGMENT

(By G.R.SWAMINATHAN, J.) Heard both sides.

2.The writ petitioner herein was serving the second respondent bank as General Manager. He retired from service on 31.01.2001. He filed W.P.(MD)No.2900 of 2011 claiming that his pay scale should be properly revised. He relied on a circular issued on 22.01.2004. Since his representation did not elicit any response, he filed W.P.(MD)No.2900 of 2011. The writ prayer was in two parts; (a) to take action against the Special Officer for not implementing the circular in favour of the petitioner; (b) to direct the management to implement the circular by paying the salary difference along with arrears. The learned Single Judge vide order dated 18.12.2020 dismissed the writ petition by invoking the principle of laches. Challenging the dismissal order, this writ appeal has been filed.

3.We are of the view that the writ petitioner need not have been thrown out on the ground of laches. However, without going into the 2/4

merits of the matter, we direct the second respondent / management to take a call in the matter. The writ petitioner is permitted to give a fresh representation to the second respondent. The second respondent will pass a speaking order thereon within a period of twelve weeks thereafter. 4.This writ appeal is disposed of accordingly. No costs. (G.R.S. J.,) & (R.K.M.
