PRAYER IN CMA(MD) No.SR36715 of 2017 To set aside the Fair and Decreetal order dated 04.04.2016 passed in I.A.No.120 of 2016 in HMOP No.828 of 2015 on the file of the Learned Family Court, Madurai and allow this Civil Miscellaneous Petition.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.MOORTHHY, Advocate for the petitioner and of MR.M.SARANGAN, Advocate on behalf of the Respondent, the court made the following order:- (Order of this Court was made by S.S.SUNDAR, J.,) This petition is to condone the delay of 495 days in filing the above C.M.A.(MD) No.SR36715 of 2017. Though the learned Counsel for the respondent has contested this petition, this Court is convinced with the reasons stated in the affidavit filed in support of this petition to condone the delay of 495 days in filing the appeal. 2.Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay is condoned. https://hcservices.ecourts.gov.in/hcservices/ 3.The Registry is directed to number the Civil Miscellaneous

Appeal, if it is otherwise in order. Since the learned Counsels appearing on either side during the course of argument submitted that the parties are interested in settling the dispute and requested this Court to refer this matter before Mediation, the Registry is directed to refer this Civil Miscellaneous Appeal for Mediation. The parties are directed to appear before Mediation centre on 21.01.2019.
