O R D E R
This Writ Petition is filed challenging the impugned refusal check slip issued by the respondent in RFL/Keelsathanur/8/2026 dated 12.01.2026 and also seeking for a consequential direction, directing the respondent to register and release the sale deed in Doc.NO.TP/244688499/2026 dated 12.01.2026, forthwith.
2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel appearing for the petitioners would submit that though the respondent issued the impugned refusal check slip, now the respondent has registered sale deed of the petitioners dated 12.01.2026. However, the respondent refused to release the said sale deed. Hence, the petitioners have filed this Writ Petition.
4. The learned counsel appearing for the petitioners would submit that in the event, if the document is under valued, the respondent is supposed to refer the matter to the concerned authorities under Section 2/6
47A of the Indian Stamp Act, 1899, for the purpose of revaluation. Instead of doing so, the respondent refused to release the document. Hence, the petitioners pray for appropriate relief.

The learned Special Government Pleader appearing for the respondent would submit that since there is under valuation, the matter will be referred to the concerned authority under Section 47A of the Indian Stamp Act, 1899. He would further submit that the respondent would release the document to the petitioners.

Considering the submissions made by the learned Special Government Pleader, this Court is of the considered view that if the respondent found that the document is under valued, it is up to him to refer the matter to the concerned authorities under Section 47-A of the Indian Stamp Act, 1899, for the purpose of redetermination of the value. Without doing so, retaining the document is not proper.
7. In view of the above, this Court directs the respondent to release the sale deed dated 12.01.2026, immediately upon receipt of the copy of this order. In the event, if it is under valuation, the respondent is 3/6
directed to refer the matter to the concerned authority for redetermination of the value of the property under Section 47-A of the Indian Stamp Act, 1899.
8. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
