ORDER

The petitioner seeks for quash of the FIR in Crime No.4 of 2023 on the file of the first respondent.

The case of the prosecution is that the petitioner, while working as a pharmacist in Amma Marundhagam at Kumbakonam had misappropriated a sum of Rs.14,95,088/-, for which the second respondent lodged a complaint against the petitioner before the 1st respondent police and an FIR in Crime No.4 of 2023 came to be registered under Sections 408, 409, 471 & 477(A) of IPC.

The learned counsel counsel appearing for the petitioner, pointing out the contents of the FIR, categorically contended that even a careful reading of the FIR itself would reveal that the petitioner has not indulged in any such misappropriation of funds, and departmental enquiry had also been initiated and the same had ended in favour of the petitioner and hence, he prays for quash of the FIR.

4. Per contra, the learned Additional Public Prosecutor submitted that a report dated 31.10.2025 has been obtained from the Deputy Registrar of Cooperative Societies and it has been clearly deliberated that the petitioner has 2/4

caused a total loss of Rs.14,22,795/- and hence, this is not a case to be considered for quashment of FIR and press for dismissal of this petition.

5. Heard the learned counsel on either side and perused the materials placed before this Court.

A careful perusal of the materials available on records would show that the claim of the petitioner can be worked out only before the trial Court and the same can be substantiated after completion of the trial. In view of the same, I do not find any merit in this criminal original petition and the same fails and is also dismissed. Consequently, connected miscellaneous petition is closed.
