Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.04.2023 to 29.10.2021, in paying the amounts paid towards his terminal and pension benefits namely EPF Employee's Contribution, Gratuity, Encashment of Leaves and Commuted Value of Pension.

O R D E R

The instant writ petition has been filed by a retired employee of the respondent Transport Corporation, seeking a mandamus directing the respondents to pay interest at the rate of 18% per annum for the belated payment of petitioner's terminal benefits.

2. According to the learned Counsel appearing for the writ petitioner, the petitioner was appointed in the transport corporation on 01.11.1996 and he had attained superannuation on 31.03.2023. The terminal benefits were disbursed belatedly to the writ petitioner only on 30.10.2024. Hence, he sent a representation on 14.11.2024, seeking interest for the belated payment. Since, there is no response from the respondents authorities, the present writ petition has been filed.

3. Considering the above said facts, the respondent Transport Corporation is directed to pay interest at the rate of 6% from the due date till the date of disbursement within a period of twelve (12) weeks from the date of receipt of a receipt of a copy of this order. 2/4

4.With the above said observations, this writ petition stands disposed of. No costs.
