RESPONDENT / RESPONDENT Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition imposed on the petitioner in the order dated 03.01.2019 passed in Cr.M.P.No. 1471 of 2018 on the file of the Sessions Court (Fast Track Mahila Court), Theni ORDER: This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.N.PRAGALATHAN, Advocate for the petitioner and of Mr.K.SUYAMBULINGA BHARATHI Government Advocate ( Criminal Side) for the respondent, the court made the following order:- The petitioner was granted bail by the Sessions Court (Fast Track Mahila Court), Theni, on 03.01.

2019, in which, the conditions imposed on the petitioner are that the petitioner is ordered to be released on bail on executing his bond for Rs.25,000/- with two sureties for the like sum each, one surety is blood relative (Mother, Father, Brother or Sister) and the petitioner is directed to produce the original property document or original patta to the satisfaction of the Court and it is further directed that the petitioner shall report before the respondent police station daily at 10.30 a.m., until further orders.

2. The learned counsel appearing for the petitioner submits that the parents of the petitioner are only agricultural labourers. They do not have any property and also the said surety amount. Hence, other condition of production of original property document or original patta to the satisfaction of the Court may be dispensed https://hcservices.ecourts.gov.in/hcservices/

with. He further submits that due to non-compliance of the conditions, even though the petitioner was granted bail on 03.01.2019, he is yet to furnish sureties and still in custody. The petitioner and his family members are indigent persons.

3. Considering the above said submission, this Court modifies the condition to the extent that the petitioner is directed to execute a bond for a sum of Rs.10,000/- [Rupees Ten Thousand only] with two sureties for a like sum and the Sessions Judge (Fast Track Mahila Court), Theni, further directed not to insist upon the blood relative as surety as well as the production of the original property document or original patta to the satisfaction of the concerned Court. Other condition imposed on the petitioner holds good.
