PRAYER :- for bail in Crime No. 619 of 2019 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner is in custody since 06.01.2020 for the offences punishable under sections 294(b), 323, 324, 506(ii) of I.P.C., and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015 in Crime No. 619 of 2019 on the file of the respondent police. He seeks bail.

3.The prosecution case is that on 13.11.2019, the petitioner brutally assaulted his own daughter in a public place causing her serious injuries.

No.1570 of 2020 4.The petitioner's counsel would claim that the petitioner's daughter was accused of having stolen a petty item from her classmate and the petitioner wanted to discipline her and when the petitioner's daughter ran away from the house, the incident in question had taken place. He would further claim that the petitioner is the sole bread winner of the family and that, therefore, the denial of bail would cause serious hardship to the family.

5.I had a conversation with the petitioner's wife as well as child. The conversation given by them is totally otherwise. 6.The learned Government Advocate (Crl.side) would state that the entire occurrence has been captured in CCTV and the brutality of the petitioner is so obvious and evident. The petitioner's daughter is a tender girl who studying in 4th standard. 7.Granting bail to the petitioner may even endanger their life and safety. I am, therefore, not inclined to grant bail to the petitioner. Hence, this criminal original petition stands dismissed.
