Heard the learned counsel on either side.

2. The petitioner seeks cancellation of the petition mentioned document under Section 77A of the Registration Act 1908. It has been held by me vide order dated 24.01.2023 made in W.P.(MD)No.18691 of 2022 that this provision cannot be invoked retrospectively. The petitioner seeks cancellation of the document executed way back on 10.12.2022. Section 77A of the Registration Act came into force only recently.

3. If the petitioner has any other claim, he has to necessarily establish before the jurisdictional civil Court. Liberty is given to the petitioner to move the jurisdictional civil Court for appropriate relief, this writ petition stands dismissed.

4. I make it clear that I have not gone into the merits of the matter. No costs.
