ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents 1 to 4 more particularly, the second respondent to consider the petitioner's representation dated 26.12.2025 on merits and in accordance with law and thereafter, pass appropriate orders in cancelling the joint patta including the name of the fifth respondent in the Revenue Patta of the properties owned by the petitioner bearing Survey Nos. 537/5b, 537/2c, 537/2e, 537/2f, 537/3b, 537/2b, 538/1b2, 538/la, 539/1 and 538/3a as situated at Poolangulam Village, Alangulam Taluk, Tenkasi District, forthwith.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the fifth respondent, notice to the fifth respondent is hereby dispensed with.

4. The learned counsel for the petitioner submits that the petitioner is the absolute owner of the subject properties. However, the fifth respondent's name was included in the Patta. The inclusion of the fifth respondent's name in the joint patta is illegal, erroneous, and without any basis in law or title. Hence, the petitioner has submitted a detailed representation dated 26.12.2025 to the second respondent seeking cancellation of the joint patta; however, no action has been taken till date.

5. The learned Special Government Pleader appearing for the respondents 1 to 4 submits that the petitioner's representation dated 26.12.2025 will be considered and appropriate orders will be passed on merits and in accordance with law.

Recording the aforesaid submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 26.12.2025, and pass appropriate orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The third respondent is directed to provide reasonable opportunity during such enquiry to the petitioner, the fifth respondent and any other persons, who may be affected by such decision. Needless to state that in the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs.
