Heard learned counsel appearing for petitioner and learned Government Advocate appearing for respondent.

2. Learned Counsel appearing for petitioner would submit that this Criminal Miscellaneous Petition has been filed under Section 5 of the Limitation Act, 1963, seeking to condone the delay of 1014 days in filing the instant Criminal Revision Case in Crl.R.C.(MD).SR.No.3189 of 2026.

3. He would further submit that respondent had registered a case against petitioner under Sections 452, 307 and 332 of IPC. Petitioner was found guilty by learned Assistant Sessions Judge, Sivakasi in S.C.No.197 of 2009 vide order dated 14.06.2018 and was sentenced (i) to undergo two years rigorous imprisonment and to pay a fine of Rs.1,000/-, in default to undergo two months simple imprisonment for offence under Section 452 IPC and (ii) to undergo five years rigorous imprisonment and to pay a fine of Rs.2,000/-, in default to undergo two months simple imprisonment for offence under Section 307 IPC and (iii) to undergo two years rigorous imprisonment and to pay a fine of Rs. 1,000/-, in default to undergo two months simple imprisonment for offence under Section 332 IPC. Petitioner preferred an appeal in Crl.A.No.77 of 2018 and the same was dismissed confirming the order passed by learned Trial Court on 11.01.2023.

4. He would further submit that petitioner has been confined at Central Prison, Madurai and was thus unable to contact his lawyer and hence there has been a delay.

5. Mr.Vaikkam Karunanithi, learned Government Advocate for respondent would submit that he does not have any serious objections in condoning the delay of 1014 days.

6. Being satisfied with reasons stated in the affidavit filed in support of this Criminal Miscellaneous Petition, the delay of 1014 days in filing the above criminal revision petition is condoned.

7. Registry is directed to number the Criminal Revision Petition, if it is otherwise in order.
