For Respondent : Mr.T.Senthilkumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.6/2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A2 who apprehends arrest at the hands of the respondent police for the offences punishable under sections under Sections 306 of IPC @ 306 @ 305 of IPC in Crime No.6 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the deceased was studying 12th standard in High school and there was an affair between the deceased and A1, hence the defacto complainant and his wife warned her. Thereafter on 08.01.2023 the accused A1 and A2 scolded the deceased in filthy language, due to which the deceased became upset and had committed suicide by hanging and also left a suicide note implicating A1 and A2, hence the case came to be registered.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and a false case has been foisted against https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.1457 of 2023 her. He would further submit that the petitioner being mother of A1, she has been falsely implicated in this case, hence he seeks anticipatory bail to the petitioner.

The learned Additional Public Prosecutor(Cri.Side) appearing for the respondent would submit that it is a case where the victim had committed suicide and she has also left a suicide note stating that the A1 and this petitioner who is the mother of A1 is responsible for her death. He would further submit that the investigation is in the initial stage, hence he objected to grant anticipatory bail to the petitioner.
5. Heard. Perused the materials available on record including the First Information Report.
6. Taking into consideration of the facts and circumstance of the case and also taking note of the fact that the investigation is in the initial stage this Court is not inclined to grant bail to the petitioner.
