P RAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to Expedite and dispose of the pending inquiry concerning the cancellation of all pattas and related entries under Survey No.385/1 in Kollampatti Village, Vedasandhur Taluk, Dindigul District and Grant Pattas to the rightful owners in accordance with partition deed and ancestral rights of the property.

By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
2. The petitioners seek the relief of writ of mandamus to expedite and dispose of the pending inquiry concerning the cancellation of all pattas and related entries under Survey No.385/1 in Kollampatti Village, Vedasandhur Taluk, Dindigul District. 2/6

According to the petitioners, as per the UDR records, Survey No.385/1K has been wrongly registered in the name of Veerappan and Pappammal under Patta No.802 and the petitioners seek for rectification of the wrong entries in the UDR records. The petitioners have submitted a representation as early as on 09.10.2023, 18.10.2023 which has been followed up with a later representation on 13.08.2024.
4. It is also seen that the District Collector, Dindigul District has also forwarded the representations of the petitioners to the Tahsildar in November, 2023. However, the learned Government Advocate appearing for the officials respondents would submit that the competent authority is the second respondent and the copy of the representation having already been marked to the second respondent, the second respondent may be directed to complete the enquiry and pass final orders on merits and in accordance with law.
5. In view of the above, the second respondent is directed to complete the enquiry on the representations of the petitioner dated 09.10.2023, 18.10.2023 which has been followed up with a later 3/6
representation on 13.08.2024 and pass orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order. It is made clear that the second respondent shall issue notice to all the parties concerned, who may be interested in the subject matter.
6. Accordingly, the writ petition is disposed of with the above direction. No costs.
