PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to implement 4% of Dearness allowance and on the base of the same to settled the difference gratuity amount and earned leave salary amount along with 6% interest on the base of the petitioner's representation dated 06.11.2024, within the time frame fixed by this Court.

ORDER

The instant writ petition has been filed by a retired employee of the respondent transport corporation seeking a mandamus to direct the respondents to implement 4% of dearness allowance and on the base of the same to settled the difference gratuity amount and earned leave salary amount along with 6% interest on the base of the petitioner's representation dated 06.11.2024.

2. A perusal of the records reveal that the petitioner submitted his representation on 06.11.2024 stating that he had voluntarily retired on 31.03.2023. The rate of Dearness allowance was refixed as 4% with effect from May 2023. Since the petitioner has retired on 31.03.2023 it was not conferred upon him. Hence, he has sent a representation on 06.11.2024 and the same has not been considered by the authorities, the present writ petition has been filed.

3. Considering the above said facts, the second respondent is directed to consider the representation of the petitioner dated 06.11.2024 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. No costs. 2/4

4. With the above said observations, this writ petition is disposed of. No costs.
