2 W.P.(MD)NO.1892 OF 2025 Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 and 2 to remove the encroachment made by the 5th Respondent in the Vellavari in S.No.46/1 and 49/2, Senkattupatti Village, Thuraiyur Taluk, Tiruchirapalli District to the breath about 10 feet and length about 300 feet and restore the Vellavari as in earlier so as to the rain water flows through the same and reaches to the nearby pond, within a time frame as fixed by this Court.

Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the official respondents.

2. It is not in dispute that the petition mentioned survey numbers have been classified as " Vari " (water bodies).

3. We direct the official respondents to survey the petition-mentioned lands. It is open to the official respondents to take aid of the jurisdictional police if necessary and conduct survey. If the survey 2/4

3 W.P.(MD)NO.1892 OF 2025 reveals any encroachment, it shall be removed by due process of law within a period of four months from the date of receipt of a copy of this order. Notices have to be issued to the encroachers and they shall be provided with due opportunity.
