To set aside the judgment and decreetal order passed by the learned District Judge, Trichy dated 08.03.2013 made in C.M.A.No.24 of 2012, confirming the judgment and decreetal passed by the learned Principal Subordinate Judge, Trichy in H.M.O.P.No.199 of 2004 dated 06.04.2011.

petitioner in both the petitions and of Mr.N.P.NARAYANA KUMAR, Advocate on behalf of the Respondent in both the petitions, the court made the following order:- These petitions are filed to condone the delay of 1391 days in preferring the Civil Miscellaneous Second Appeal. 2.Being satisfied with the reasons stated in the supporting affidavits filed for condonation, delay of 1391 days is condoned and the petitions stand ordered on condition that the petitioner should pay a sum of Rs.1,00,000/- (Rupees One Lakh only) to the Resident Medical Officer, Government Hospital for Thoracic Medicine, Thoppur, Madurai District, by way of Demand Draft, within a period of two weeks from today, failing which, these petitions shall stand dismissed automatically, without further reference to this Court. 3.On production of payment receipt, the Registry is directed to number the Civil Miscellaneous Second Appeals and post the matters for admission, if it is otherwise in order.
