ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody since 19.11.2018 for the offences punishable under Sections 8(c) r/w, 20(b) (ii) (c), 29(i) and 25 of NDPS Act, in Crime No.60 of 2018, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 19.11.2018 on secret information, the Inspector of Police, Q Branch, Nagapattinam, searched the accused persons and their Cars and they found 256 Kilo grams of Ganja in eight bags. Thereafter, they arrested the accused persons and seized the contraband and handed over the accused person along with the contraband to the respondent police and registered the case.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor would submit that the contraband is commercial quantity and the petitioner is not satisfying the requirement under Section 37 of NDPS Act. https://hcservices.ecourts.gov.in/hcservices/ 5.Considering the materials seized in this case is commercial quantity and since the petitioner is not satisfying the requirement

under Section 37 of NDPS Act, this Court is not inclined to grant bail to the petitioner.

6.Accordingly, this Criminal original petition stands dismissed.
