PRAYER: Contempt Petition is filed under Section 11 of the Contempt of Courts Act, to punish the contemnors 1 to 3 for disobedience of the order made in W.P. ORDER

(Order of the Court was made by J.NISHA BANU, J.) This contempt petition is filed alleging disobedience of the order passed by this Court in W.P.(MD)No.16701 of 2023 dated 12.07.2023. 2.The writ petition filed by the petitioner seeking to remove the encroachment in the subject properties, was disposed of with a direction to the official respondents herein to remove the encroachment by following due process of law. Since the said order was not complied with, the present contempt petition is filed.

3.The learned Special Government Pleader appearing for the respondents submits that after the disposal of the writ petition, appropriate steps were taken by the respondents and the encroachments were identified. Thereafter, after issuing notice to the encroachers, when the respondents went to survey the property, the encroachers obstructed for the same and made protest. Therefore, the survey could not be conducted. He further submits that necessary police protection shall be given to the respondents for removal of encroachment. 2/5

4.The submission made by the learned Special Government Pleader is recorded.

5.As per the directions issued by this Court, the respondents have taken necessary action to remove the encroachment in the subject property. Hence, this Court does not find any violation of the order passed by this Court. 6.Further, it is submitted that there were some obstructions for removal of encroachment. Hence, the Superintendent of Police, Virudhunagar District is directed to give necessary police protection to the official respondents herein for removal of encroachment.
