ORDER

This Petition has been filed to quash the F.I.R in Crime No. 428 of 2024 on the file of the first respondent police.

2. The crux of the case is that the second respondent/defacto complainant gave a complaint before the first respondent police stating that on account of theft committed in the shop of his wife, he lodged a complaint on 10.08.2022. On 19.08.2022, he went to the police station for an enquiry, where the accused persons assaulted the defacto complainant and threatened him to withdraw the complaint and the same was refused by him. Based on the same was registered in Crime No.428 of 2024 on 30.07.2024 for the offence under Sections 166, 294(b), 323, 506(i) IPC.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent. Perused the materials available on record.

4. On perusal of the records, this Court satisfy with the ingredients of the offences under Sections 166, 294(b), 323, 506(i) IPC and the same is required to be investigated by the police officer. 2/6

manner of doubt that fair investigation was not done. Hence, this Court finds no reason to entertain this quash petition when the allegations made in the FIR, prima facie constitute the offences under Sections 166, 294(b), 323 and 506(i) IPC. Further, this Court is unable to accept the argument of the learned counsel for the petitioner to appreciate the material produced before this Court and the defence of the petitioner at this stage. 5.Accordingly, this Criminal Original Petition is dismissed. The respondent Police is directed to file final report in Cr.No.428 of 2024 before the concerned Court within a period of six (6) months from the date of receipt of copy of this order. The petitioner is at liberty to file a petition for quash, after filing of final report, if so advised. Consequently, connected Miscellaneous Petition is closed.
