ORDER
This petition has been filed seeking to quash the proceedings in Crime No.141 of 2015 on the file of the respondent.
2. The learned counsel for the petitioners would submit that the case filed by the petitioner has been been registered in Crime No.141 of 2015 for the offence punishable under Sections 341, 294 (b), 323, 506(i) IPC r/w Sections 3 and 4 of Tamil Nadu Prohibition of Charging Exorbitant Interest Act, 2003.
3. The learned Additional Public Prosecutor would submit that in the above said case, investigation has been completed and charge sheet has also been filed in C.C.No.218 of 2018 on 28.09.2019 before the learned Judicial Magistrate, Nilakottai and the same is yet to be taken on file.
4. Inasmuch as the final report have been filed in the complaint given by the petitioner, nothing survives for further adjudication in the present petition.
5. However, it is close to five months since the final report in this case is said to have been filed before the Court. Hence, the learned Chief Judicial Magistrate, Dindigul is now directed to hold an enquiry as to why the final report was not taken on file by https://hcservices.ecourts.gov.in/hcservices/
the learned Judicial Magistrate, Nilakottai for the last five months.
