ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1 in Crime No.01 of 2011 on the file of the respondent police, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 420 and 406 IPC r/w 4, 76 of Chit Fund Act, seeks anticipatory bail.

2. Heard both sides.

3. For the non-appearance of the petitioner herein before the trial Court, the trial Court has rightly issued Non Bailable Warrant against her.

4.The learned counsel for the petitioner would submit that the petitioner realized her mistake of her non appearance before the Court, but that mistake was on account of circumstances beyond the control of the petitioner and that therefore, the non-bailable warrant must be recalled.

5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner, subject to the following conditions:

(i) The petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned (*)Chief Judicial Magistrate, Trichy, Trichy District.

(ii) The petitioner shall appear before the concerned Court in all future hearings without fail.

(iii) the petitioner shall tender apology to the Lower Court for having absented herself without even filing a petition under Section 317 Cr.P.C.
