PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India, against the fair and decreetal order dated 29.11.2024 in I.A.No.14 of 2024 in O.S.No.245 of 2021 on the file of the District Munsif-cum-Judicial Magistrate, Thiruchuli.

O R D E R

The plaintiffs in O.S.No.245 of 2021on the file of the District Munsifcum-Judicial Magistrate, Thiruchuli, have filed the present Civil Revision Petition, challenging the dismissal of their application in I.A.No.14 of 2024 filed for sending for the original certified copies of documents mentioned in the petition by summoning the Tahsildar and the Village Administrative Officer, Thiruchuli.

2. A perusal of the records reveal that the present suit has been filed for the relief of declaration of title and permanent injunction. When the suit is posted for arguments, the plaintiffs have filed this application to call for the original revenue records to be summoned from the office of Tahsildar as well 2/6

as the Village Administrative Officer, Thiruchuli. This application came to be dismissed by the trial Court primarily on the ground that the plaintiffs could get the documents from the concerned office and produce before the Court below and the trial Court has further found that the entire burden would be upon the plaintiffs to prove the Will dated 12.10.1994. Challenging the said order, the present Civil Revision Petition has been filed.

According to the learned counsel appearing for the revision petitioners, the revenue records which are uploaded in the Government website are not been accepted by the trial Court and this prompted the plaintiffs to summon the Tahsildar as well as the Village Administrative Officer for production of the original records. He further contends that one Muthukumar is the original owner and the suit properties are ancestor properties of the said Muthukumar and therefore, no document stands in his name. Unless the original revenue records produced, it will be difficult for establishing his case before the concerned Court.

4. Heard the learned counsel appearing for the petitioners and perused the material on records.

In case, if the plaintiffs wishes to produce the revenue records which are uploaded in the Government website, he is always at liberty to produce the revenue records and the Court shall accept it and receive those documents after verifying the bar code attached to the said documents. In such circumstances, it is not necessary either to summon the Tahsildar or the Village Administrative Officer for production of the original records. Therefore, this Court is not inclined to interfere in the said order and there are no merits in the Civil Revision Petition.

6. Accordingly, this Civil Revision Petition stands dismissed. There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.
