ORDER

Alleging wilful disobedience of the order passed by this Court in W.P.(MD).No.22635 of 2018 dated 03.12.2018, the Contempt Petition has been filed.

2. The petitioner has served as Teacher and has attained superannuation and receiving pension. However, the petitioner had filed the Writ Petition seeking to take temporary service rendered by him from 14.08.1990 to 31.12.1997 and fix the revised pension. The said Writ Petition was allowed directing the respondents to take 50% of the said service.

3. Today when the matter is taken up for hearing, the learned Special Government Pleader circulated a letter dated 12.04.2023 submitting a proposal for granting permission to the Headmaster to submit a revised proposal so that it can be processed and the order may be complied. 2/4

4. Since, the proposal has been submitted, this Court is of the considered opinion that there is no contempt as alleged. However, the respondents are directed to fully comply with the process within a period of twelve (12) weeks from the date of receipt of a copy of this order.

5. Recording the same, this Contempt Petition is closed. However, if the order of this Court is not complied by the respondents within the prescribed period, then liberty is granted to the petitioner to re-open the Contempt Petition. 13.04.2023 NCC : Yes / No Index : Yes / No Internet : Yes Nsr To The District Education Officer, District Education Office (DEO), Puthukkotai District.
