Heard Mr.R.Paranjothi, for M/s.KBS Law Office, learned Counsel for the petitioner, Mr.B.Saravanan, learned Additional Government Pleader appearing for the respondents 1 & 2 and Mr.M.Suresh, learned Counsel appearing for the third respondent. 2.The limited ground of challenge to the order of the District Revenue Officer / first respondent is that, though the petitioner was given notice, the contentions of the petitioner has not been considered before the impugned order came to be passed. 3.Learned Counsel for the third respondent would fairly submit that the impugned proceedings can be set aside and the matter can be remitted to the first respondent for fresh hearing, after giving an opportunity to the petitioner and the respondents 3 and 4 and in a time bound manner.

4.In view of the concession shown by the learned Counsel for the third respondent, the impugned order is set aside and the matter is remitted to the first respondent for conducting enquiry, after affording opportunity to the petitioner, the respondents 3 & 4 and also any other interested parties and thereafter, the first respondent shall pass final orders on merits and in accordance with law within a period of eight [8] weeks from the date of receipt of a copy of this order.

5.The Writ Petition is allowed, with the above direction. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
