Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to forbear the District Library Officer, Thanjavur/6th respondent herein not to constructing any building in the property comprised in old S.No.331/2B 53 New Survey No.331/2B 53/3 having patta No.361 situated at Karaiyoor Street, Adirampattinam, Pattukottai Taluk, Thanjavur District on the basis of the gift/settlement deed executed by one Thalaivar Karaiyoor Street.

O R D E R

This writ petition has been filed to forbear the sixth respondent not to construct any building in the property comprised in old S.No.331/2B 53 New Survey No.331/2B 53/3 having patta No.361 situated at Karaiyoor Street, Adirampattinam, Pattukottai Taluk, Thanjavur District.

2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. Heard the learned counsel appearing on either side and perused the materials placed before this Court. 2/5

3. Without expressing any opinion on merits of the writ petition, the third respondent is directed to conduct an enquiry on the request made by the petitioner and pass orders on merits and in accordance with law, after issuing notice and after giving opportunity of hearing to the petitioner and counter party, if any, within a period of twelve weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is also closed.
