: Respondents [Crime No.15 of 2019] PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C, to issue a direction directing the respondent no.1 to withdraw the case in Crime No.15 of 2019 dated 29.01.2019 on the file of the respondent no.3 and entrust the same to the respondent no.1 for monitoring and an investigation of the case by a competent officer and a final report before the Jurisdictional Magistrate within the time stipulated by this Court.

ORDER

The present petition is filed to change the investigation agency from the third respondent to any other investigating agency to investigate the case registered in Crime No.15 of 2019 on 29.01.2019 for the offence under Sections 143, 147, 294(b), 352, 323, 506(ii) IPC and Sections 3(1)(r) and 3(1)(s) of the Scheduled Caste and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.

2. When the matter is taken up for hearing, the learned Additional Public Prosecutor submitted that there are 11 accused persons. Of all, the first accused was arrested and others are absconding. The investigation is seriously underway. https://hcservices.ecourts.gov.in/hcservices/

3. Suffice to say for the present, this Court is not inclined to transfer the investigating agency, but to direct the first respondent to monitor the course of investigation by the second respondent. The second respondent is also directed to conclude the investigation to his logical end as expeditiously as possible under the circumstances.

4. With the above direction, this criminal original petition is disposed of.
