ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to Judicial custody on 17.01.2019, for the alleged offence punishable under Sections 489(B), 489(C) of IPC in Crime No. 11 of 2019, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner was found in possession of counterfeit currency notes worth Rs.2700/-. Hence the complainant.
3.The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case and he has nothing to do with the alleged offence and he is innocent and hence, he would pray for bail.
4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner along with another person went to Trivandrum and obtained Rs.10000/- counterfeit currency notes by giving Rs.5000/- original notes. He would also submit that after spend of Rs.7300/- , the balance amount of Rs.2700/- was given in the tasmac shop, the accused was arrested and hence he objected for grant of bail. https://hcservices.ecourts.gov.in/hcservices/
5.Considering the facts and circumstances of the case and considering the fact that the counterfeit currency notes are recovered from the petitioner and the fact that the investigation is at the initial stage, this Court is not inclined to grant bail to the petitioner.
6. Hence the bail petition is dismissed.
