ORDER : The Court Made the following order :- The petitioners, who are arrayed as A2 to A5 apprehend arrest at the hands of the respondent police for the alleged offences punishable under sections 143, 294(b), 355, 506(i) of IPC and section 4 of Tamil Nadu Prohibition of Women Harassment Act, in Crime No.69 of 2015 on the file of the respondent police and hence, seek anticipatory bail. 2.The case of the prosecution is that due to previous enmity with regard to civil dispute between the accused and the de-facto complainant, the accused entered into the vacant site of the de-facto complainant and dumped wooden logs and when this was questioned, the accused abused him with filthy language and attacked the de-facto complainant and his wife with chappels and also threatened the de-facto complainant with dire consequences.

3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Criminal side) appearing for the respondent submitted that the injured has been discharged from the hospital.

5.Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Peraiyur, Madurai District and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two https://hcservices.ecourts.gov.in/hcservices/

sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners 1 and 3 shall appear before the respondent police as and when required for interrogation and the petitioners 2 and 4 shall appear before the respondent police daily at 10.00 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
