ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 420, 120(b) of IPC and Section 5 of TNPID Act, 1997 in Crime No.01 of 2016 on the file of the respondent police, seeks anticipatory bail.

2.The petitioner was functioning as a director of one Rajakamangalam Benefit Fund. The petitioner was a director for about five years from 2009 to 2014. The said financial establishment committed default. The total liability of the financial establishment comes to Rs.2,20,00,000/-. There were originally nine directors. Each of the directors had contributed certain sums of money towards settling their share of the liability. The petitioner herein had contributed a sum of Rs.18,00,000/-. 3.The learned counsel for the petitioner submits that the said amount was directly paid to some of the depositors and original receipts are now with the petitioner.

4.Taking note of the fact that the petitioner had contributed only a sum of Rs.18.00 lakhs towards the liability of the financial establishment and the fact that the substantial portion of the deposits were directly paid to some of the depositors, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

5.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned TNPID Court, Madurai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
