ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.3, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 206, 207, 409, 418, 424, 434, 462, 477 r/w 120(b) of IPC, in Crime No.13 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.
2.The case of the prosecution is that the registration copies of the documents sought by one Balasubramanian claiming right over the immovable properties was destroyed by the accused.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case only on suspicion and the petitioner cannot influence the first accused/Sub Registrar for taking away the Registration Certificate. It is further submitted that quash petition filed by the first accused was admitted and interim stay was also granted.
4.The learned Government Advocate (crl.side) submitted that in Crl.O.P.No.4023 of 2015, this Court after elaborately considering the rival submissions of the parties, dismissed the application observing that this is not a fit case for granting anticipatory bail. Subsequent application of the petitioner was also dismissed. 5.Considering the above fact, this Court is not inclined to grant anticipatory bail to the petitioner.
