For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.130 of 2014 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police, in pursuant to NBW issued by the Special Court for Exclusive Trial of cases under POCSO Act, Thanjavur in SSC No.62 of 2019, for the offences punishable under Sections 366(A), 342 IPC r/w 6 of POCSO Act, in Crime No.130 of 2014, seeks anticipatory bail.

2.It is submitted by the learned Government Advocate (Crl.Side) appearing for the respondent would submit that due to absence of the petitioner, the Special Court issued NBW against him, by cancelling the bail that was granted to the petitioner.

3.Reading of the order shows that on the basis of the petition moved by the Public Prosecutor in Crl.MP No.849 of 2021, bail that https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.1579 of 2022 was granted to the petitioner was cancelled and NBW was issued. When that being the position, the question of anticipatory bail may not arise. The only remedy available to the petitioner is that he has to surrender before the concerned Court.

5.With the above said liberty, this Criminal Original Petition is disposed of.
