Respondents/Respondents PRAYER : This Civil Revision Petition is filed under Section 227 of the Constitution of India, to call for records and set aside the fair and executable order dated 29.06.2020 passed in the Civil Miscellaneous Appeal (Co-operative Societies) in C.M.A. (C.S) No.12 of 2019 on the file of the Principal District Court, Ramanathapuram (Co-operative Tribunal) confirming the order dated 10.02.2019 passed in Surcharge Proceedings No. 05/2017-2018 (Na.Ka.No.2173/2017 SaPa (2)) by the Deputy Registrar of Co-operative Societies, Paramakudi.

DECREE:- This Civil Revision Petition having come up for final hearing on this date, upon perusing the grounds of Petition, the order of the Trial Court and the material papers to the Petition and upon hearing the arguments of Mr.T.R.Jeyapalam, Counsel for the Petitioner, Mr.M.Senthil Ayyanar, Government Advocate For the respondents,this Court while disposing the petition, doth order and decree as follows:

i)that the order, dated 29.06.2020 made in C.M.A(C.S)No.12 of 2019 passed by the Principal District Judge, Ramanathapuram (Cooperative Tribunal), is hereby set aside. ii) that the matter is remitted back to the learned Principal District Judge, Ramanathapuram (Co-operative Tribunal) for fresh consideration after discussing the charges and considering the explanation given by the petitioner.

iii)that the Principal District Judge, (Co-operative Tribunal) Ramanathapuram do restore the matter in its original number in the register and proceed to dispose the same in the light of the observation and directions contained in the Judgment herein, https://hcservices.ecourts.gov.in/hcservices/ 1/2
