Criminal Original Petition filed under section 482 of Criminal Procedure Code, to direct the respondent No.1 to 4 not to harass the petitioner without any legally sustainable complaint and to direct the respondent No.3 and 4 to follow the guideline issued by the Supreme Court in D.K.Basu (1997 1 SCC 416) case in matters pertaining to arrest or interrogation. This petition has been filed seeking direction to the respondent No.1 to 4 not to harass the petitioner without any 1/3

legally sustainable complaint and to direct the respondent No.3 and 4 to follow the guideline issued by the Supreme Court in D.K.Basu (1997 1 SCC 416) case in matters pertaining to arrest or interrogation.

2.Today when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents Police would submit that earlier the petitioner was a history sheeter in Vilakuthoon Police Station and therefore, history sheet has been opened against him on 17.06.2001 as H.S.No.466 of 2001. Thereafter, since the petitioner is not having any case for the past five years, proposed has been made by the third respondent to close it and the respondents have not harassed him. 3 Recording the aforesaid submission, this Criminal Original Petition is closed. Consequently, the connected criminal miscellaneous petition is also closed.
