This criminal original petition has been filed for a direction to direct the second respondent to produce the detenue namely Mrs. Saranya D/o.Ganapathi aged about 19 years before this Honourable Court and set her liberty from the illegal custody.
2. The petitioner who is stated to have married one Saranya D/o.S.Ganapathi has filed a petition seeking to produce her before this Court and set her at liberty. On the earlier occasion the second respondent was present before this Court and he had furnished the statements recorded from the alleged detenue who was produced before him wherein she had stated that there was no legal marriage between her and the petitioner. However the counsel for the petitioner raised suspicion with regard to the statements recorded by the Inspector of Police, thereby this Court directed the Assistant Superintendent of Police, Colachel Sub Division, Kanyakumari District to conduct enquiry. CRL.O.P.(MD)No.1715 of 2020 Court enquiry has been conducted by the Assistant Superintendent of Police, Colachel Sub Division on 02.02.2020 and the report is filed today. It reveals that no legal marriage was solemnized between the petitioner and the alleged detenue and no records were produced by the petitioner with regard to the marriage with Saranya. Further during enquiry the said Saranya had informed that she on her own volition is living with her parents.
3. At this juncture the learned counsel for the respondents 3 and 4 would submit that fourth respondent's daughter denied the marriage with the petitioner and she has stated that she is living with her parents on her own volition.
4.Recording the said submission, this criminal original petition is closed.
