ORDER

Seeking a direction to the 1st respondent to transfer investigation pertaining to the complaint dated 19.12.2025 on the file of 2nd respondent to the 3rd respondent, this criminal original petition is filed.

2. The learned counsel for the petitioner submitted that the accused persons forged the petitioner's signature, obtained a Life Certificate, and sold the property belonging to the petitioner. In this regard, the petitioner lodged a complaint on 19.12.2025, which is presently pending before the 2nd respondent. All the accused persons, including the doctor, were summoned. The doctor deposed that not only was the petitioner's signature forged, but his signature was also forged. Despite the complaint having been lodged on 19.12.2025, no case has been registered so far. Therefore, the petitioner seeks the indulgence of this Court.

The learned Government Advocate (Crl.Side) submitted that after receiving complaint from the petitioner, the 2nd respondent police issued summons under Section 35(3) of BNSS as against the petitioner required him to produce the supporting materials to substantiate his allegations against the proposed accused. However, he has not turned up, for which the learned counsel for the petitioner categorically contended that as against all the accused against whom the complaint had been lodged by him were already summoned by the 2nd respondent police and the enquiry has been elaborately conducted. Though the doctor who had issued Life Certificate had appeared, the entire investigation has not been concluded so far and the 2nd respondent police is dragging on the investigation. The learned Government Advocate (Crl.Side) made it clear that the doctor had appeared and had denied his signature.

4. Heard the learned counsels on either side and perused the materials available on record.

Since the complaint has been lodged by the petitioner on 19.12.2025 and enquiry is in progress, the 2nd respondent Police is directed to conclude the investigation as expeditiously as possible within a period of four (4) weeks from the date of receipt of copy of this order and apprise the progress of the investigation every Friday before the 1st respondent police. Further, the 1st respondent police is directed to monitor the ongoing investigation which is undertaken by the 2nd respondent police.

6. With the above directions, this Criminal Original Petition stands allowed.
