O R D E R

The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 147, 148, 294(b), 323, 324, 427 and 506(ii) of IPC in Crime No.25 of 2023 on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution, as per the de-facto complainant, is that due to an election dispute between the parties, the accused persons have abused the de-facto complainant in filthy language and also assaulted him resulting in him sustaining injuries and also criminally intimidated him. Hence, the complaint. 3.The learned Counsel for the petitioner would submit that the petitioner is an innocent and a false complaint has been given against the petitioner due to an election dispute. He would also submit that the petitioner is ready to abide by any stringent conditions, that may be imposed on him. Hence, he would seek for anticipatory bail to the petitioner.

4.The learned Government Advocate (crl.side) would submit that it is a case of grievous offence, as the wrist of the victim had been cut and he is still taking treatment in hospital and he would submit that the case has now also been altered to one under Section 307 of IPC and the investigation is in initial stage. https://www.mhc.tn.gov.in/judis 1/2

CRL.O.P(MD)No.1490 of 2023 5.Considering the submission made by the learned Government Advocate (crl.side) and also taking into consideration the fact that the investigation is in initial stage and the victim was suffered a cut injury in his wrist and is still under treatment, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed.
