Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to direct the second Respondent not to harass the Petitioner under the guise of an enquiry without due process of law, on basis of the Petitioner's complaint dated 22.01.2024.

ORDER

This Criminal Original Petition has been filed seeking direction against the Respondent Police not to harass the Petitioner under the guise of an enquiry.

2. The learned Counsel for the Petitioner submitted that the the third Respondent is the wife of the Petitioner's brother. The brother of the Petitioner died. There was civil and money dispute between the Petitioner and the third Respondent. In this regard, a complaint was preferred by the third Respondent against the Petitioner, based on which the second Respondent Police summoned the Petitioner to attend enquiry at odd hours. Aggrieved over the same, the Petitioner sent a representation dated 22.01.2024 to the first Respondent regarding harrasment. Since no action was taken, the present petition is filed.

3. The learned Additional Public Prosecutor appearing for the Respondents 1 and 2 on instructions, submitted that CSR No.18 of 2024 was registered and it was pending. He further submitted that after conducting enquiry, the Respondents 1 and 2 undertake to follow the circular of Director General of Police, Tamil Nadu, Chennai, in Rc.007301/Genl.I(1)/2019, dated 09.04.2019 and Additional Director General of Police in C.No.18/ADGP/L&O/Camp/2024.

4. Recording the submission of the learned Additional Public Prosecutor, this Criminal Original Petition is closed.
