ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to Judicial custody on 13.01.2019, for the alleged offence punishable under Sections 302 IPC @ 147,148,342,302 of IPC in Crime No. 17 of 2019, on the file of the respndent police, seeks bail. 2.The case of the prosecution is that the petitioner induced the defacto complainant purchased precious Nagamani stone from the petitioner, for which he had given Rs. 3,00,000/- to the petitioner. Thereafter it came to light that the stone purchased by the defacto complainant is not a precious stone and thereafter he requested to return back the money, due to which a wordy quarrel arose between them and thereby he sustained injuries in his vital part and died in the hospital. Hence the complainant.
3.The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case and he has nothing to do with the alleged offence and he is innocent and hence, he would pray for bail.
4.The learned Additional Public Prosecutor appearing for the respondent police would submit that investigation is at the preliminary stage and if he is released of bail, the entire trial will be affected and hence he objected for grant of bail. https://hcservices.ecourts.gov.in/hcservices/
5.Considering the facts and circumstances of the case and considering the fact that the case is at the preliminary stage, this Court is not inclined to grant bail to the petitioner.
6. Hence the bail petition is dismissed.
