O R D E R

The present writ petition has been filed seeking to quash the order passed by the respondents herein, wherein, the request of the petitioner for issuance of legal heir certificate for the death of her mother has been rejected.

2. A perusal of the impugned order reveals that the petitioner's mother namely, Fathima Bi had passed away on 09.11.1998. As per the death certificate, the place of death is shown as Shasthery Nagar, Chennai - 41. The petitioner has made an application to the respondent herein seeking legal heir certificate. The same has been rejected on the sole ground that the permanent address of the deceased person is in Chennai and therefore, they cannot entertain the same.

3. The learned counsel appearing for the petitioner pointed out that the petitioner's father was a railway employee and the mother was receiving pension. The pension payment order of the petitioner's mother reveals that the permanent address at 10-E , Railway Colony, Dindigul. 2/4

4. In view of the above said facts it is clear that the order impugned passed by the Tahsildar, Madurai cannot be interfered with. However, the petitioner is at liberty to approach the concerned Tahsildar seeking Legal Heir Certificate relying upon the pension payment order of the deceased mother of the writ petitioner.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.
