PRAYER: Criminal Original Petition filed under Section 438 of Cr.P.C, praying to enlarge the petitioner on bail in the event of his arrest by the respondent Police with respect to Cr.No.181 of 2022.

O R D E R
The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Section 379 of IPC in Crime No.181 of 2022 on the file of the respondent Police, seeks anticipatory bail.
2.The case of the prosecution, as per the de-facto complainant, is that the petitioner along with the other accused had committed theft of Motor Pump from the agricultural field of the de-facto complainant. Hence, the case.
3.The learned Counsel for the petitioner would submit that the petitioner is an innocent person and he has been implicated in this case only based on the confession statement of the co-accused. He would further submit that this is the second application for anticipatory bail and the earlier petition in Crl.O.P.(MD)No.66 of 2023 was dismissed by this Court, by order, dated 04.01.2023 taking into consideration the bad antecedents of the petitioner. He would submit that now the investigation has been completed and would pray for anticipatory bail to the petitioner.
4.The learned Government Advocate (Crl. side) would submit that the petitioner is a habitual offender and even against whom, there are three previous cases, which were registered by the respondent police. Hence, he opposed for grant of anticipatory bail. https://www.mhc.tn.gov.in/judis
5.Heard. Perused the materials available on record including the First Information Report.
6.Taking into consideration the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
