ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused in Crime No.118 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 07.06.2015 for the alleged offences punishable under Section 302 of I.P.C., and hence, seeks bail. 2.According to the prosecution, A2 is the wife of deceased and when the deceased was in abroad, she developed illicit intimacy with A1 and she had spent the amount sent by the deceased lavishly with A1 and after the deceased came to India, objected the illicit intimacy of the accused and therefore, on 07.06.2015, the accused have attacked the deceased with knife and caused death. 3.
The learned counsel for the petitioner submitted that when the deceased was in abroad, he was sending money to another lady with whom he was having illicit relationship. The learned counsel further submitted that the lady belongs to the different community, which was objected by the petitioner and she left the matrimonial home and now, she is residing with her parents. It is further submitted that the petitioner is an innocent person and he has been falsely implicated in this case.
4.The learned Government Advocate (Crl.side) would submit that https://hcservices.ecourts.gov.in/hcservices/ both the accused have been secured and the major part of the investigation is over.
5.Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail on condition that the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Melur and on further condition that the petitioner shall reside at Palani and report before Palani Adivaram Police Station daily twice ie., at 10.00 a.m., and 05.00 p.m., until further orders. sd/- 01/09/2015 / TRUE COPY / ` Sub-Assistant Registrar TO 1 THE JUDICIAL MAGISTRATE, MELUR.
