O R D E R

(Order of the Court was made by G.K.ILANTHIRAIYAN, J.) This Habeus Corpus Petition has been filed to direct the second respondent to produce the petitioner's daughter Vilva Sathya, D/o.Linganathan aged about 18 years before this Court and set him at liberty.

2. The petitioner is the father of the detenue. The detenue is aged about 19 years. While being so, she fell in love with the third respondent and eloped with him and got married him. Therefore she apprehends threat at the hands of the petitioner and his wife, thereby she lodged complaint alleging that she faced threat at the hands of the petitioner and his wife on the ground that she got married with another community person. Thereafter she lodged complaint before the

Inspector of Police, Kadaladi Police Station, Ramanathapuram District, however no action was taken. Further the detenue approached this Court in Crl.O.P(MD) No.22286 of 2025 seeking adequate police protection to her and her husband, however it was dismissed for non prosecution.

Now the petitioner being father of the detenue lodged another complaint as if she was missing from his house before the second respondent and the same has been registered in Crime No.438 of 2025 under 'woman missing'. During investigation the second respondent found that the detenue/missing person is aged about 19 years and she got married with the third respondent and also lodged complaint before the Inspector of Police, Kadaladi Police Station, Ramanathapuram District seeking adequate police protection at the hand of the petitioner and his wife.

4. While it being so, the victim is now major, got married with another person and she is living separately and also apprehending

threat at the hands of the petitioner and his family. The petitioner suppressing all these facts has filed this petition seeking production of detenue. In view of the same, the Habeus Corpus Petition is not maintainable and liable to be dismissed.
