ORDER
Mr.T.Leninkumar, learned counsel appearing for the petitioner contended that though the learned Judicial Magistrate, Pattukottai, directed the Inspector of Police, All Woman Police Station to investigate the allegations made by the present petitioner and send a report vide his orders dated 06.02.2020 in C.M.P.No.758 of 2020, the respondent police yet to take any action. 2.Mr.S.Chandrasekar, learned Additional Public Prosecutor, who accepts notice on behalf of the respondent, on instructions, would submit that the petitioner lodged a complaint containing the same set of allegations before the respondent police and the same was registered in Crime No.7 of 2017 and after conducting investigation, final report was filed in C.C.No.117 of 2018 by the All Woman Police Station, Pattukottai.
3.However, a copy of the complaint dated 03.08.2019 filed by the present petitioner before the Judicial Magistrate, Pattukottai in C.M.P.No.758 of 2020 shows that the petitioner has leveled certain allegations against her husband subsequent to the filing of CC.No.117 of 2018 that he threatened her with dire consequences and https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.1693 of 2021 the Magistrate had directed the Inspector of Police, All Women Police Station, Pattukottai to investigate into the allegations made by the petitioner. When the Magistrate refers a case under Section 156(3) of the Code of Criminal Procedure, the police is bound to register First Information Report and investigate the matter. This has not been done by the Inspector of Police, All Women Police Station, Pattukottai.
4.In the circumstances, the Inspector of Police, All Woman Police Station is directed to register the First Information Report and investigate into the allegations made by the present petitioner.
5.With the above observation, the Criminal Original Petition is disposed of.
