This writ petition has been filed for issuance of a writ of mandamus directing the 2nd respondent to conduct an enquiry and to take action based on the representation made by the petitioners on 09.03.2019 and as per the direction issued by the first respondent through letter dated 12.07.2019.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

3. The grievance expressed by the petitioner is that the Former Secretary and the Treasurer belonging to the Karur District Cricket Association had misappropriated funds belonging to the association. An FIR was also registered in this regard in Crime No.1/2015 by the CBCID. A representation was also made by the petitioners to the respondents to take action and on receipt of the same, the first respondent through letter dated 12.07.2019 directed the 2nd respondent to conduct an enquiry and 2/5

to pass an order. Since the same did not evoke any response from the second respondent, the present writ petition has been filed.

Taking into consideration the facts and circumstances of the case and without going into the merits of the case, there shall be a direction to the second respondent to act upon the representation/complaint made by the petitioners on 09.03.2019 calling upon the parties for an enquiry and take a decision on its own merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. If no decision has been taken till date, the petitioner is directed to make a fresh representation to the second respondent along with all the relevant documents and also a copy of this order. Before passing the order, the second respondent is expected to hear all the parties concerned and thereafter take a decision. This writ petition is disposed of accordingly.
