Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the Nazareth Urban Co-operative Bank Limited (O.212), the second respondent herein to consider the representation dated 11.01.2022 of the petitioner settle the housing loan as OTS payable to the second respondent bank after availing the waiver of interest for the COVID19 pandemic period and any other eligible concession. ORDER
I am afraid I should not pass any orders on the Writ Petition in view of the judgment of the Hon'ble Supreme Court in Civil Appeal.No.7411 of 2021 in The Bijnor Urban Co-operative Bank Limited, Bijnor and others Vs. Meenal Agarwal and others, dated 15.12.2021.
2. The relief sought in the present Writ Petition is to consider a representation of the petitioner, with respect to one time settlement, by the second respondent.
3. Learned counsel for the petitioner, however, also understood the position, but stated that the petitioner may be https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD).No.1612 of 2022 permitted to participate in Lok Adalat conducted by the second respondent with respect to the aforesaid issue of settlement.
4. Participation in the Lok Adalat, is a right of the petitioner provided the second respondent conducts the Lok Adalat. Thus, the petitioner may certainly participate in the same and put forth his offer for settlement. That is an issue entirely between the petitioner and the second respondent.
5. With the said observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed.
