(Crime No.324 of 2017) : Respondents PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the first respondent to conduct fresh investigation in Crime No.324 of 2017 dated 17.10.2017 on the file of the respondent No.3 and alter First Information Report under Sections 279 and 337 IPC.

ORDER

The present petition has been filed seeking direction to the Investigating Agency to alter the FIR in Crime No.324 of 2017 registered under Sections 279 and 337 IPC.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent Police.

3. The learned counsel for the petitioner submits that in a road accident the petitioner dashed against an Auto-Rickshaw, which according to him, has stopped suddenly without any intimation.

However, the FIR was registered against the https://hcservices.ecourts.gov.in/hcservices/

petitioner and this fact was not adequately highlighted.

4. The learned Government Advocate (Crl.Side) submitted that the case was charge sheeted and taken on file in S.T.C.No.500 of 2019 before the learned Judicial Magistrate, Nilakottai.

5. In view of the subsequent developments, nothing survives for further adjudication in the present petition. However, the petitioner is at liberty to pursue such remedy as may be available to him under law before the concerned Magistrate and if the petitioner needs a certified copy of the final report, the same may be obtained as per law.

8. With the above direction, this criminal original petition is disposed of.
